JPM Landscape Terms of Service

These Terms of Service govern your use of JPM Landscape’s website and services. By accessing our website or engaging our services, you agree to these terms.

About JPM Landscape

JPM Landscape has provided professional landscape design, installation, and maintenance services in the San Jose area for over 38 years. We are fully licensed (California Contractor License #963784), bonded, and insured with Best of Houzz recognition for service excellence.

Service descriptions and scope

Landscape design services include site consultation, design development, plant selection, and project planning. Design ownership remains with JPM Landscape for portfolio and marketing purposes, with usage rights granted to clients for their specific project. 

Installation services include site preparation, hardscape construction, planting, irrigation system installation, and project completion according to approved designs and specifications.

Maintenance services include ongoing care, pruning, fertilization, pest management, and seasonal adjustments to support landscape health and appearance.

Project contracts and change orders

All landscape projects exceeding $500 require written contracts with detailed specifications, timelines, and payment schedules.  The down payment may not exceed $1,000 or 10 percent of the contract price, whichever is less. It is against the law for a contractor to collect payment for work not yet completed or materials not yet delivered. 

Change orders require written approval from both parties and may affect project timeline and total cost. Weather conditions, site discoveries, or client-requested modifications may necessitate scope adjustments that will be documented and approved before implementation.

Payment terms and policies

Payment schedule: Standard terms require 50% deposit upon contract signing, with remaining balance due upon project completion and client approval. Large projects may include progress payments aligned with completion milestones.

Late payments incur a 1.5% monthly service charge.

Refund policy: Consultation fees are non-refundable. Project deposits are refundable within three business days of contract signing, subject to California home improvement cancellation rights.

Plant materials and warranty terms

ne-year limited warranty covers plant materials and workmanship under proper care conditions. Warranty excludes damage from drought, overwatering, pest infestation, weather extremes, vandalism, or failure to follow care instructions. Plant replacement is provided one time only during optimal planting seasons.

Client responsibilities include proper watering according to provided schedules, basic maintenance, and protection from physical damage. Warranty coverage requires adherence to recommended care practices and may be conditioned on professional maintenance agreements.

Liability limitations and insurance

Our total liability is limited to the contract value for any project. We maintain comprehensive general liability insurance ($2 million), workers’ compensation coverage, and professional liability protection. Clients are responsible for verifying property lines and utility locations before work begins.

Force majeure: Weather delays, permit issues, or circumstances beyond our control may affect project timelines without liability.  We will communicate promptly about any scheduling impacts and work to minimize delays.

Intellectual property and design protection

Landscape designs created by JPM Landscape are protected by copyright law. While clients receive usage rights for their specific project, JPM Landscape retains ownership for portfolio use, marketing purposes, and professional recognition submissions including award competitions. vided materials, photos, and property information remain confidential and are used solely for project purposes unless otherwise authorized.

Dispute resolution and governing law

Disputes will be resolved through good-faith discussion, followed by mediation if necessary. These terms are governed by California law and subject to San Jose County jurisdiction.

Contractor licensing information

Information about the Contractors State License Board (CSLB): CSLB is the state consumer protection agency that licenses and regulates construction contractors. Contact CSLB for information about the licensed contractor you are considering, including information about disclosable complaints, disciplinary actions, and civil judgments that are reported to CSLB. Use only licensed contractors. If you file a complaint against a licensed contractor within the legal deadline (usually four years), CSLB has authority to investigate the complaint. Your only remedy against unlicensed contractors may be in civil court, and you may be liable for damages arising out of any injuries to the unlicensed contractor or their employees. Cancellation rights

California residents have the right to cancel most home improvement contracts within three business days of signing. This cancellation right applies to contracts signed at locations other than the contractor’s established place of business. Cancellation must be in writing and submitted before midnight of the third business day after contract signing. and modifications
